According to the canonical formulation of the modal account of luck [e.g. Pritchard (2005)], an event is lucky just when that event occurs in the actual world but not in a wide class of the nearest possible worlds where the relevant conditions for that event are the same as in the actual world. This paper argues, with reference to a novel variety of counterexample, that it is a mistake to focus, when assessing a given event for luckiness, on events distributed (...) over just the nearest possible worlds. More specifically, our objection to the canonical formulation of the modal account of luck reveals that whether an event is lucky depends crucially on events distributed over all possible worlds–viz., across the modal universe. It is shown that an amended modal account of luck which respects this point has the additional virtue of avoiding a notable kind of counterexample to modal accounts of luck proposed by Lackey (2008). Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. While valuable work has been done addressing clinical ethics within established healthcare systems, we anticipate that the projected growth in acquisitions of community hospitals and facilities by large tertiary hospitals will impact the field of clinical ethics and the day-to-day responsibilities of clinical ethicists in ways that have yet to be explored. Toward the goal of providing clinical ethicists guidance on a range of issues that they may encounter in the systematization process, we discuss key considerations and potential challenges in (...) implementing system-wide ethics consultation services. Specifically, we identify four models for organizing, developing, and enhancing ethics consultation activities within a system created through acquisitions: train-the-trainer, local capacity-building, circuit-riding, and consolidated accountability. We note each model’s benefits and challenges. To our knowledge, this is the first paper to consider the broader landscape of issues affected by consolidation. We anticipate that clinical ethicists, volunteer consultants, and hospital administrators will benefit from our recommendations. (shrink)

Interpretive understanding of human behaviour, known as verstehen, underpins the divide between the social sciences and the natural sciences. Taking a historically orientated approach, this collection offers a fresh take on the development of understanding within analytic philosophy before, during and after logical empiricism. In doing so, it reinvigorates debates on the role of the social sciences within contemporary epistemology. Bringing together leading experts including Martin Kusch, Thomas Uebel, Karsten Stueber and Giuseppina D'Oro, it is an authoritative reference on (...) the logical empiricists' philosophy of social science. Charting the various reformulations of verstehen as proposed by Wilhem Dilthey, Max Weber, R.G Collingwood and Peter Winch, the volume explores the reception of the social sciences prior to logical empiricism, before surveying the positive and negative critiques from Otto Neurath, Felix Kaufmann, Viktor Kraft and other logical empiricists. As such, chapters reveal that verstehen was not altogether rejected by the Vienna Circle, but was subject to various conceptual uses and misuses. Along with systematic historical coverage, the book situates verhesten within contemporary interdisciplinary developments in the field, shedding light on the 21st-century 'turn' to understanding among analytic philosophers and opening further lines of inquiry for philosophy of social science. Subsequent essays expand upon these themes, drawing on a range of theological and social-scientific perspectives. Most could serve as introductions for undergraduate or graduate classes. The volume also invites disability scholars to examine whether and how this “Vanier school” has succeeded in its attempt to reimagine and serve both those with and those without obvious impairments.For Vanier’s “school,” such reimagining entails perceiving those with impairments as “teachers.” Executing this, however, is difficult. Xavier Le Pichon, for example, argues that “the disabled” help us recover positive views of dependency in “childhood innocence” and “aged suffering” (since they embody both stages). Focusing on the suffering that human beings experience before death, he claims that paleo-anthropological evidence suggests that societies evolved as their care of the disabled taught them to accept suffering. His argument, however, risks strongly identifying persons with their impairments, thus reinforcing the social construction of “disability” as a marginalizing category in discourse and policy.Moreover, this difficulty is not limited to associations with disvalue. Hans Reinders draws on Søren Kierkegaard and Hans Ulrich in a comparison of the severely disabled to the “teachers” of Matthew 6: the birds and lilies. The disabled, he argues, embody a positive image of “humanity” characterized by dependence on God and a lack of competition with others. Such an image of grace “frees” one from a political economy that drives toward rational mastery of self and world. Yet, do the severely impaired always experience and manifest such dependence? If not, are they not being used to create a “human” image for others in which they, in fact, do not appear?Kevin Reimer’s essay contains similar difficulties. For him, the instructive values are “trust” and “gracious openness.” Citing studies that demonstrate how these values sustain communities—even absent rational agreement—he argues that they should replace rationality as the chief marker of moral maturity (as exemplified, e.g., in Lawrence Kohlberg’s stages of moral development). Like Reinders, Reimer clearly wants those with cognitive impairments to be appreciated as teachers of values that displace the rationalist ones that deprecate them. However, like Reinder’s argument, this easily slides toward defining “humanity” under a certain ideal form, thereby still implicitly devaluing those who do not embody that ideal form. Also, one finds here the danger of romanticizing that is often identified with Vanier: one only sees the form and not the real person.William Gaventa and Brian Brock, however, provide a counterresponse, the first pivotal turn in the book. Gaventa argues that the discovery of another’s value as “teacher” occurs only when one has already acknowledged her as a person (104). Here Vanier’s argument for mutual receptivity becomes a fundamental anthropology that grounds an ethic. When modern ethical contractualists defend their view against “teleology,” they typically have in mind utilitarian or consequentialist theories according to which valuable states of affairs are to be promoted. But if we look to older teleological theories e.g. that found in the philosophy of St. Thomas Aquinas we will find a kind of teleology that can be incorporated beneficially into contractualist ethics. In this paper I argue that Scanlon would be well served, on grounds to which he appeals, to make (...) a teleological modification to his theory of what we owe to each other. Drawing not only on Aristotle and Aquinas, but also on the thought and life of Martin Luther King, I argue that Scanlon's contractualism can and should be modified to incorporate the ancient and medieval teleological emphasis on personal fruition and legitimate self-assertion. Almost four decades ago, Kathleen Pearson examined deceptive practices in sport using a distinction between strategic and definitional deception. However, the complexity and dynamic nature of sport is not limited to this dual-categorization of deceptive acts and there are other features of deception in sport unaccounted for in Pearson's constructs. By employing Torres’s elucidation of the structure of skills and Suits's concept of the lusory-attitude, a more thorough taxonomy of in-contest sport deception will be presented. Despite the ubiquitous presence of (...) deception in sport, few scholars have examined this concept in the sport philosophy literature since Pearson’s contribution. This paper hopes to advance a deeper understanding of deceptive practices in competitive sport and also comment on the ethical permissibility of certain sport skills from a moral perspective. The present article aims to explain Kamala??la’s understanding of the nature of insight, specifically considering it as the ‘discernment of reality’ -- a technical term identified with insight in the author’s well known Bh?van?krama? texts. I approach my analysis of bh?ta-pratyavek?? from three different angles. I begin by providing a rationale for its translation. This is followed by an account of Kamala??la’s reading of key passages in the La?k?vat?ra S?tra describing the process to which the term refers. Here the aim (...) is to illustrate Kamala??la’s understanding of bh?ta-pratyavek?? as it is actually experienced in meditation. The final section examines bh?ta-pratyavek?? in relation to other important technical terminology employed in the course of making arguments against his historical rival in debate, the Ch’an monk Mo ho yen. By providing these three different perspectives on the same process it is my hope that both scholars and practitioners will be able to more fully comprehend and benefit from the instructions provided by the ancient master Kamala??la. It is a natural assumption in mainstream epistemological theory that ascriptions of knowledge of a proposition p track strength of epistemic position vis-à-vis p. It is equally natural to assume that the strength of one’s epistemic position is maximally high in cases where p concerns a simple analytic truth. For instance, it seems reasonable to suppose that one’s epistemic position vis-à-vis “a cat is a cat” is harder to improve than one’s position vis-à-vis “a cat is on the mat”, and (...) consequently, that the former is at least as unambiguous a case of knowledge as the latter. The current paper, however, presents empirical evidence which challenges this intuitive line of reasoning. Our study on the epistemic intuitions of hundreds of academic philosophers supports the idea that simple and uncontroversial analytic propositions are less likely to qualify as knowledge than empirical ones. We show that our results, though at odds with orthodox theories of knowledge in mainstream epistemology, can be explained in a way consistent with Wittgenstein’s remarks on ‘hinge propositions’ or with Stalnaker’s pragmatics of assertion. We then present and evaluate a number of lines of response mainstream theories of knowledge could appeal to in accommodating our results. Finally, we show how each line of response runs into some prima facie difficulties. Thus, our observed asymmetry between knowing “a cat is a cat” and knowing “a cat is on the mat” presents a puzzle which mainstream epistemology needs to resolve. (shrink)

We show that in infinite worlds the following three conditions are incompatible: The spatiotemporal ordering of individuals is morally irrelevant. All else being equal, the act of bringing about a good outcome with a high probability is better than the act of bringing about the same outcome with a low probability. One act is better than another only if there is a nonzero probability that it brings about a better outcome. The impossibility of combining these conditions shows that it is (...) more costly to endorse than has been previously acknowledged. (shrink)

In this paper we present two distinctly epistemological puzzles that arise for one who aspires to defend some plausible version of the precautionary principle. The first puzzle involves an application of contextualism in epistemology; and the second puzzle concerns the task of defending a plausible version of the precautionary principle that would not be invalidated by de minimis.

In a recent paper in this journal, we proposed two novel puzzles associated with the precautionary principle. Both are puzzles that materialise, we argue, once we investigate the principle through an epistemological lens, and each constitutes a philosophical hurdle for any proponent of a plausible version of the precautionary principle. Steglich-Petersen claims, also in this journal, that he has resolved our puzzles. In this short note, we explain why we remain skeptical.

In articulating a theological account of Christian hope faithful to its objective character, Pope Benedict XVI summons the authority of Thomas Aquinas, citing his comments on faith and hope as those terms occur in Hebrews 11:1. Benedict sets off Aquinas's understanding of hope-filled faith's objectivity by placing it in contrast with Luther's apparently more subjective interpretation of faith in Hebrews 11:1 as conviction. Closer analysis of both Aquinas and Luther, however, suggests a greater overlap in their exegetical conclusions, opening the (...) way for a more nuanced appreciation of a virtue whose living possession and exercise, as the rest of Spe Salvi confirms, involves both objective and subjective dimensions. Aside from making a few weak, and hopefully widely shared claims about the value of privacy, transparency, and accountability, we will offer an argument for the protection of privacy based on individual self-interest and prudence. In large part, this argument will parallel considerations that arise in a prisoner’s dilemma game. After briefly sketching an account of the value of privacy, transparency, and accountability, along with the salient features of a prisoner’s dilemma games, a game-theory analysis will be offered. In a (...) game where both players want privacy and to avoid transparency and the associated accountability, the dominant action will be to foist accountability and transparency on the other player while attempting to retain one’s own privacy. Simply put, if both players have the ability or power to make the other more accountable and transparent, they will do so for the same reasons that player’s defect in a prisoner’s dilemma game. Ultimately this will lead to a sub-optimal outcome of too much accountability and transparency. While there are several plausible solutions to prisoner dilemma games, we will offer both technical, as well as, law and policy solutions. We need to change the payoffs of the game so that is it in everyone’s interest to balance privacy and accountability rather than foisting transparency on others. (shrink)

In people with chronic low back pain, maladaptive structural and functional changes on a cortical level have been identified. On a functional level, somatosensory cortical excitability has been shown to be reduced in chronic pain conditions, resulting in cortical disinhibition. The occurrence of structural and/or functional maladaptive cortical changes in people with CLBP could play a role in maintaining the pain. There is currently no measurement protocol for cortical excitability that employs stimulation directly to the lower back. We developed a (...) protocol for the measurement of single pulse somatosensory evoked potential waveforms and paired-pulse behavior generated from sensory nerves of the lower back and quantified its test–retest reliability in a sample of 30 healthy individuals to gain insights into the normal variability of cortical responses, which could then be compared to results from people with CLBP. We investigated cortical excitability by measuring SEPs and PPB. PPB was defined as the ratio of the amplitude of the second cortical response divided by the first cortical response. A2s was determined by subtracting the response to single-pulse stimuli from the paired pulse stimuli response to account for linear superposition effects. The test–retest reliability of the protocol was very poor with no evidence of systematic bias but a high amount of random variability between sessions. There was no significant difference in the right side PPB for session 1 and session 2 ; mean session difference [ = −0.44 ; t = −1.17, p = 0.26]. The ICC3.1 for the outlier-removed right side PPB were 0.19 and 0.43 for left side PPB. This finding potentially has wider implications for PPB protocols. If these findings were replicated in other groups and other nerves, it would question the validity of this measure more generally. However, these findings are restricted to healthy people and sensory nerves of the lower back and may not be generalizable. (shrink)

In this work, on the one hand, we examined the relationship between emotional intelligence (EI) and empathy and, on the other, the relationship between emotional intelligence and nonverbal sensitivity, through two independent studies. The first study analyzed the relationship between dimensions of emotional intelligence and aspects of empathy, in a sample of 856 participants who completed two measures of EI, the Trait Meta-Mood Scale (TMMS) and the Trait Emotional Intelligence Questionnaire (TEIQue), and a measure of empathy, The Interpersonal Reactivity Index (...) (IRI). The results showed a similar pattern of significant positive relations in all the EI domains with empathic Perspective-taking, and significant negative relationships with empathic Personal Distress, except for the EI domain of Attention, which had a positive relationship. Stepwise multiple regression analyses showed that the dimension that best predicted empathic Perspective-taking and Empathic Concern was the Emotionality Factor; whereas Attention best predicted empathic Fantasy; and the Self-Control Factor best predicted Personal Distress, although negatively. Gender emerged as a predictor of three empathic aspects, Fantasy, Empathic Concern, and Personal Distress, with women obtaining higher scores than men in all of them. Age was the only predictor of Fantasy, with a negative relationship. The second study involved 646 people who completed the same measures of EI as the participants of the first study and the Mini-Profile of Nonverbal Sensitivity (Mini-PONS). The results showed some significant relationships between EI dimensions and the channels and quadrants of the MiniPONS. Stepwise multiple regression analyses showed that very few EI dimensions predicted nonverbal sensitivity, with Attention obtaining the best result. Both gender and age emerged as predictors, some in unique cases, of channels, quadrants and of the total score of nonverbal sensitivity; age had a negative relationship, and women obtained higher scores than men. Social and cultural contexts influence power dynamics and shape gender perceptions, roles, and decisions regarding the management of agrobiodiversity for dealing with and adapting to climate change. Based on a feminist political ecology framework and a mixed method approach, this research performs an empirical analysis of two case studies in the northern of India, one in the Himalayan Mountains and another in the Indian-Gangetic plains. It explores context-specific influence of gender roles and responsibilities on on-farm agrobiodiversity management gendered expertise and (...) knowledge related to agrobiodiversity and gendered preferences for practices and institutional arrangements for agrobiodiversity conservation linked to adaptation to climate change. In the Himalayan mountains women actively participate in crop and seed management decisions and tasks, and maintain informal institutions for seed and services exchanges in the case of crisis, which simultaneously favours high levels of agrobiodiversity and enhances women’s social status. By contrast, in the Indio-Gangetic plains, where women from better-off households are socially secluded and women from poorer households work mainly as labourer to respond to high out-migration of men, they exercise less public control over agrobiodiversity, with their role being mainly invisible at the homestead and related to post-production tasks. We finally discuss as improved understanding of the links between gendered spaces, crops, tasks, social status, and agrobiodiversity management can facilitate the design of gender-sensitive policy interventions for conservation and adaptation to climate change. Should there be a female age limit on public funding for assisted reproductive technology (ART)? The question bears significant economic and sociopolitical implications and has been contentious in many countries. We conceptualise the question as one of justice in resource allocation, using three much-debated substantive principles of justice—the capacity to benefit, personal responsibility, and need—to structure and then explore a complex of arguments. Capacity-to-benefit arguments are not decisive: There are no clear cost-effectiveness grounds to restrict funding to those older women (...) who still bear some capacity to benefit from ART. Personal responsibility arguments are challenged by structural determinants of delayed motherhood. Nor are need arguments decisive: They can speak either for or against a female age limit, depending on the conception of need used. We demonstrate how these principles can differ not only in content but also in the relative importance they are accorded by governments. Wide variation in ART public funding policy might be better understood in this light. We conclude with some inter-country comparison. New Zealand and Swedish policies are uncommonly transparent and thus demonstrate particularly well how the arguments we explore have been put into practice. (shrink)

In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)
